These General Terms and Conditions for the use of the WBS information system (hereinafter referred to as the "General Terms and Conditions") govern the relationship between WEB BOOKING SERVICES Ltd. as owner and administrator of the WBS information system, and end users regarding the use of the website, available on the Internet address: https://www.byouteeq.com.
WEB BOOKING SERVICES Ltd. reserves the right to update and amend the General Terms and Conditions to respond to the changes in the way the byouteeq.com website operates, as well as the conditions related to changes in legal requirements and regulations. With their publication on the site, it is considered that the General Terms and Conditions have become public. It is the obligation of the Users to periodically check the content of this Document.
"User" / "User of Service" - any natural or legal person of proper capacity who uses the functionality of the information system "WBS" provided through the site https://www.byouteeq.com and/or has registered on it with the aim to search and book services provided by the "Service Providers", as a result of which it has received a non-exclusive, non-transferable and temporary right to use the "WBS" information system.
"Service Provider" - any natural or legal person of proper capacity, regardless of their legal form, who uses the functionality of the information system "WBS" provided through the site https://www.byouteeq.com and has registered on it in order to provide services through their Organization and Site(s) on the Website, as a result of which it has successfully created an account and received a non-exclusive, non-transferable and temporary right to use the "WBS" information system.
The information system "WEB BOOKING SERVICES" (IS "WBS") - is a web-based platform, available at www.byouteeq.com, which provides functionality for registration and management of Organizations, Sites and Services of Service Providers, as well as functionality for searching, booking of services and registration of Users of those services.
Site content - includes various types of data, text, information, software, sound, music, photos, graphics, videos, and any other type of material published or provided for publication on the site.
The use of the website byouteeq.com by the Users is completely free. Users of Services owe a fee for the reserved services provided by the Service Providers, which is settled directly between the two parties. The terms of use of those services are defined by the Service Providers and do not concern the Administrator of the "WBS" platform.
WEB BOOKING SERVICES Ltd. engages to maintain the WBS IS, in particular the byouteeq.com website with the necessary standards and care of a good trader and information service provider.
WEB BOOKING SERVICES Ltd. engages to constantly develop and improve the services offered by WBS on the website byouteeq.com.
WEB BOOKING SERVICES Ltd. is not an intermediary or a third party in the relations between the users and the service providers through the website.
WEB BOOKING SERVICES Ltd. does not guarantee and is not responsible that the services provided by the suppliers will satisfy the users, nor that the access to the website will be continuous or completely secure.
WEB BOOKING SERVICES Ltd. does not guarantee that the content of the site, published or provided by the service providers is true, of high quality and reliable. Users of the website use its content voluntarily and take their own risk.
WEB BOOKING SERVICES Ltd. has no obligation to control the way of how Users and Service Providers use the Website, nor the obligation to verify, track or store the information that Users or Service Providers upload, use, copy, distribute or make available in any way to third parties.
WEB BOOKING SERVICES Ltd. has the right to send unsolicited marketing messages to users of the site, as well as to communicate with them through other communication platforms. By accepting these General Terms and Conditions, users agree to receive unsolicited marketing messages, and each user has the right to refuse to receive them at any time.
WEB BOOKING SERVICES Ltd. reserves the right to suspend access to the profile of each site of service provider or to delete their content at its discretion and without giving notice when it is contrary to these Terms and Conditions or mandatory rules of the law.
WEB BOOKING SERVICES Ltd. has the right to suspend access to user profiles at its discretion if it considers that the respective users have exceeded their rights, violated the ethical norms or the terms of use.
WEB BOOKING SERVICES Ltd. has the right to block access to the website to any user who abuses the provided opportunity to book services in this regard: saves hours and does not visit the sites without notifying them; saves hours and then often cancels them; behaves disrespectfully and rudely when visiting sites; does not observe the generally accepted morality and/or the provisions of the law.
WEB BOOKING SERVICES Ltd. has the right, but not the obligation, to provide information about the respective offending user to the competent authorities.
WEB BOOKING SERVICES Ltd. is not liable to users, service providers and third parties for any lost profits or damages as a result of the termination or restriction of access to the website. This includes damages to the user's software or hardware, as well as damages due to data loss.
In case that the USER finds that his username and/or password has been stolen or suspects that third parties have known them in any way or could otherwise access his account, if he has created one on the website, it is obliged to change them immediately.
The USER, understanding the nature of the service for providing information and the dynamics of its change, accepts as normal and agrees that "WEB BOOKING SERVICES" Ltd. has the right to change without prior notice the content of the website in order to improve and adapt it to new technologies and requirements.
The USER engages to observe good standards of communication with the other USERS and Service Providers of IS "WBS", based on mutual respect and esteem of the individual.
The USER engages not to publish, send by e-mail or otherwise content of the website which is personal data and other identifying information regarding a third party without his permission.
The USER engages not to publish, send by e-mail or otherwise in the IS "WBS" content of political, religious, discriminatory, pornographic and violent nature, as well as any content that damages the prestige and identity of third parties.
The USER accepts and agrees that in case of non-compliance with the General Terms and Conditions, "WEB BOOKING SERVICES" Ltd. has the right to terminate or restrict the USER's access to the system.
The USER provides by his own the access to the Internet for the use of the website. The parties agree that the inability of the USER to use the WBS IS due to lack of Internet connection or temporary cancellation of this connection is not a ground for filing claims against WEB BOOKING SERVICES Ltd.
Any User who has registered on the website has the right to terminate his registration and to request the deletion of his personal data.
In case the User wishes to terminate his registration in the WBS IS, he should submit a written request in free form to the address: info@byouteeq.com.
The deletion of the personal data of the User is carried out in a volume that does not contradict to the legal provisions for storage of personal information.
The storage, processing and deletion of personal data in/from the IS "WBS" is regulated in a separate document describing the Privacy Policy of the IS "WBS".
A user who has withdrawn his consent to the processing of personal data is not entitled to book services through the website.
WEB BOOKING SERVICES Ltd. is the owner and administrator of IS "WBS" and is the holder of all intellectual property rights over it.
The contents of the WBS IS, including (not exhaustively listed), design, menus, document icons and buttons, etc. items are subject to copyright or related rights with all rights reserved for "WEB BOOKING SERVICES" Ltd.
No one has the right to use, reproduce, modify, transmit (electronically or otherwise), display publicly and/or provide to third parties part or all of the contents of IS "WBS " (including source code, text or program files or other separate files), without the express permission of "WEB BOOKING SERVICES" Ltd., for the purpose of developing software, commercial purpose or other activity or to derive other benefit as well as to take any other action, with which it infringes or assists in infringing the intellectual property right of "WEB BOOKING SERVICES" EOOD over IS "WBS". Performing the above actions, etc. is prohibited and will be prosecuted in full accordance with the law.
Possession or use of IS "WBS", respectively of its separate modules without legal grounds is a violation of the Law on Copyright and Related Rights and the infringer is liable under Art. 96a, art. 96b and Art. 97 of the that law, unless his act constitutes a more serious violation, punishable under the Criminal Code.
WEB BOOKING SERVICES Ltd. is not responsible for any losses - direct, indirect or consequential damages and lost profits, as a result or in connection with the use of WBS IS, as well as for the improper use or incompetence and lack of attempted use of WBS IS, including (not exhaustively listed) data loss and damage, disruption of business relations, employment contracts or other relationships, monetary losses and lost profits or gains.
WEB BOOKING SERVICES Ltd. does not confirm and is not responsible for the information provided by the SERVICE PROVIDERS in IS "WBS" for their sites, products and services offered in them.
WEB BOOKING SERVICES Ltd. does not confirm and is not responsible for the information contained in websites to which there are hyperlinks or integrations within IS "WBS", as well as for the privacy policy and for the offered products, services and others in the referring websites.
WEB BOOKING SERVICES Ltd. is not responsible for violations in the functioning of IS "WBS" caused by external hardware or drivers, installations of other software products, defects and problems in the operating system, unauthorized access and attempts by unauthorized persons to intervene, copy, lose, destroy or modify software components, mechanical damage, as well as virus infection and/or their removal.
WEB BOOKING SERVICES Ltd. is not responsible for difficult and/or delayed use of IS "WBS", in case the Internet provider of the User has not provided sufficient speed of the Internet service.
WEB BOOKING SERVICES Ltd. under no circumstances is liable for damages in excess of the price paid by the User for IS "WBS", regardless of whether the User has notified "WEB BOOKING SERVICES" Ltd. of the possibility of such damages.
All disputes between the User and WEB BOOKING SERVICES Ltd. in connection with the interpretation and application of these General Terms and Conditions are resolved by mutual consent, and in case of disagreement - by the arbitral tribunal of the Bulgarian Chamber of Commerce and Industry, in accordance with its Rules. based on arbitration agreements.
The provisions of the current legislation in the Republic of Bulgaria shall apply to the issues not settled in these General Terms and Conditions, regardless of the registered office or residence of the User.
